International Call to Action

Prepare for the Cuban Five Court Decision: Organize "Day After" Protests & Press Conferences!

The National Committee to Free the Cuban Five has issued a call for international "Day After" actions, immediately upon the 11th Circuit Court of Appeals decision.

We urge supporters to organize press conferences and/or rallies at government offices in the United States, and at U.S. embassies or other U.S. symbols abroad, and to promote a massive letter-writing campaign to the U.S. President and U.S. Attorney General.

We also ask that organizations mobilize in larger numbers and intensify the support in the days and/or weeks following the court ruling.

Demand: Free the Five Now!
No More U.S. government appeals!

The new decision of the three-judge panel of the 11th Circuit, on nine key issues of appeal for the Five, could come at any time. It may take weeks, months or even a year or more. Nobody will know the date of the court opinion until it is issued, but we can prepare ahead of time to act immediately when the ruling comes.

History has shown that political cases are won with the people's support and by exposing the truth. The struggle of the Cuban Five is no exception.

If the court decides favorably for the Five on any of the appeals issues, the U.S. government will likely try to appeal to the full panel of 12 judges of the 11th Circuit. We need to tell Washington with a united voice: Stop delaying the Five's freedom!

To the extent that pressure is brought to bear on Washington, and to the degree that the people are made aware of the U.S. government's persecution of the Five, much will depend on the coordinated, united and determined will of the Cuban Five's supporters.

Background to the Call:

On August 9, 2005, the Cuban Five won an historic victory on their appeal before the three-judge panel of the federal 11th Circuit Court of Appeals in Atlanta.

The panel ordered a new trial for the Five and overturned their convictions.

If a new trial for the Five had been held in another city in the United States, with the experience of the defense team, with the discovery of even more terrorist plots in Miami since the first trial, we are very confident that the Five would have been exonerated.

In fact, by law a new trial would have already taken place by February 2007.

But the U.S. government fought against a new trial for the Five, because it is the U.S. government's policy of terror against Cuba that would have been on trial.

What happened to the Five's victory? Disgracefully but not surprisingly, the U.S. government, through U.S. Attorney General Alberto Gonzales and the Miami U.S. Attorney's office, appealed the 2005 decision of the 3-judge panel.

Exactly one year later--in what could only have been a political decision, on August 9, 2006--the full panel of 12 judges, in an extremely conservative court, ruled 10 to 2 to deny a new trial. The en banc panel reinstated the convictions and sentences of the Five. It was a cruel and very bitter blow to our brothers--Gerardo, Ramón, Antonio, Fernando, and René--who have had to suffer more years of imprisonment.

Worldwide mobilizations for the Five will be critical

The U.S. government has a double standard, which allows terrorists like Orlando Bosch and Luis Posada Carriles to go free in Miami, while the Five were arrested, tried and convicted in the midst of Miami's anti-Cuba hysteria.

The U.S. policy of supporting the terrorists and imprisoning the Five, has convinced virtually all who learn of their case, that the Five have been subjected to a great injustice and it must be reversed.

Coordinated rallies and/or press conferences, for both the Day After the court decision, and larger mobilizations in following weeks, will help expose this hypocrisy and show broad support for the Five's freedom.

Let us remember that when their supporters have come together, we have achieved our goals: from the New York Times ad in 2004, to the emergency response that helped free the Five from the cruel isolation cells in March 2003,

Suggested Plan of action:

1. Decide gathering place, and time (e.g., 5:00 pm on a weekday, 12 noon if the action is a weekend) and begin to publicize.

2. Produce a flyer [download sample flyer below] that you can distribute at political events and to the contacts in your area; create a special list serve of new supporters you meet who want to be notified of the emergency actions.

3. Send us details of your planned actions to webmaster@Freethefive.org . We will post them on freethefive.org and help publicize them.

4. Do outreach to the media in your area ahead of time, so they are aware of the case, the pending decision and your plans. Send a press communique as soon as court decision is issued, with news of the decision, the demand for the Five's freedom and details of your event(s). We will hold a telephone press conference immediately after the court decision is announced and disseminate that information right away.

5. As soon as the court opinion is announced, we will launch a letter-writing campaign to the U.S. President and U.S. Attorney General, demanding the Five's freedom and no more government appeals against them.

Prepárate para la Decisión de la Corte sobre los Cinco: Organiza Protestas y Ruedas de Prensa "El Día Siguiente"

El Comité Nacional para la Liberación de los Cinco Cubanos ha emitido la convocatoria internacional de acciones "El Día Siguiente", inmediatamente después de la decisión del 11no. Circuito de la Corte de Apelaciones.

Llamamos a todos los que apoyan esta causa a organizar ruedas de prensa y/o mítines frente a las oficinas gubernamentales en los Estados Unidos, y las embajadas u otras dependencias de los Estados Unidos en el extranjero, y a promover una campaña masiva de envío de cartas dirigidas al Presidente y al Fiscal General de los EEUU.

También pedimos a las organizaciones hacer más movilizaciones e intensificar el apoyo en los días y/o semanas siguientes al fallo de la Corte.

A Exigir: ¡Liberen a los Cinco AHORA!
¡No más apelaciones del gobierno de los EEUU!

La nueva decisión del panel de tres jueces del 11no. Circuito acerca de los nueve puntos clave de la apelación para los Cinco puede llegar en cualquier momento. Podrá tomar semanas, meses, un año, o más. Ninguna persona sabrá la fecha de la opinión de la Corte hasta que ésta sea emitida, pero nosotros podemos prepararnos por adelantado para actuar inmediatamente cuando llegue la decisión.

La historia ha demostrado que los casos políticos son ganados con el apoyo popular y mediante la exposición de la verdad. La lucha de los Cinco Cubanos no es una excepción.

Si la Corte decide favorablemente para los Cinco en alguno de los puntos de la apelación, el Gobierno de los EEUU tratará probablemente de apelar al panel completo de doce jueces del 11no. Circuito. Es preciso reclamar a Washington con una sola y unida voz: ¡Basta ya de dilatar la liberación de los Cinco!

El alcance de la presión que se ejerza sobre Washington y el grado en que las personas adquieran conciencia acerca del acoso de los Estados Unidos contra los Cinco, dependerá en mucho de la voluntad coordinada, unida y determinada de todos los que apoyan la Causa de los Cinco Cubanos.

Los acontecimientos del caso:

El 9 de agosto del año 2005 los Cinco Cubanos alcanzaron una victoria histórica en su apelación ante el panel de tres jueces del 11no. Circuito de la Corte Federal de Apelaciones de Atlanta.

El panel ordenó un nuevo juicio para los Cinco y revocó sus condenas.

Si hubiera tenido lugar un nuevo juicio para los Cinco en otra ciudad de los Estados Unidos, con la experiencia del equipo de la defensa, con el descubrimiento de aún más planes terroristas en Miami desde que se celebró el primer juicio, nosotros estamos seguros de que los Cinco hubieran sido exonerados.

De hecho, según la ley, el nuevo juicio habría tenido lugar ya en febrero de 2007.

Pero el gobierno de los EEUU se opuso a un nuevo juicio para los Cinco, porque habría sido la política de terror del gobierno de los EEUU contra Cuba la que habría estado en ese juicio.

¿Qué pasó con la victoria de los Cinco? Desgraciadamente, pero no sorprendentemente, el gobierno de los EEUU, a través de su Fiscal General, Alberto Gonzales, y la oficina del Fiscal de los EEUU en Miami, apeló la decisión que el panel de tres jueces tomó en el año 2005.

Exactamente un año después - el 9 de agosto de 2006, lo cual pudo haber sido solamente una decisión política - el panel completo de 12 jueces, en una corte extremadamente conservadora, denegó un nuevo juicio en una votación de 10 a 2. El panel en banc retomó las condenas y sentencias de los Cinco. Este fue un golpe cruel y muy amargo para nuestros hermanos - Gerardo, Ramón, Antonio, Fernando, y René - quienes han tenido que sufrir más años en prisión.

Las movilizaciones a nivel mundial por la Causa de los Cinco serán decisivas

La política de los EEUU de apoyar a los terroristas como Luis Posada Carriles, mientras que encarcela a los Cinco, ha convencido virtualmente a todo el que estudia este caso, de que los Cinco han sido sujetos a una gran injusticia y de que esto debe de ser revertido.

La coordinación de mítines y/o conferencias de prensa, tanto para el Día Siguiente de la decisión de la Corte, y más movilizaciones en las semanas siguientes, ayudará a exponer esta hipocresía y a mostrar el pleno apoyo a la liberación de los Cinco.

Permítanos recordar que cuando todos los que apoyan a los Cinco se han unido hemos alcanzado nuestras metas: desde el anuncio en el New York Times en el año 2004, hasta la respuesta de emergencia que ayudó a sacar a los Cinco de las crueles celdas de aislamiento en marzo de 2003.

Sugerencias para el Plan de Acción:

1. Lugar de reunión seleccionado y hora (ej. 5:00 pm en días de trabajo, 12 m si la acción será en fin de semana) y comenzar a darle propaganda.

2. Emitir un volante (bajar el ejemplo de volante que aparece más abajo) que usted puede distribuir en los eventos políticos y en los contactos en su área; crear una lista especial de nuevas personas dispuestas a apoyar y que quieran ser notificadas de las acciones de emergencia. Podemos ayudarles, haciendo una versión del volante con la información de su evento local.

3. Enviarnos los detalles de las acciones que usted planifica a webmaster@Freethefive.org. Nosotros las publicaremos en freethefive.org y ayudaremos a darles propaganda.

4. Contactar a los medios de difusión en su área con tiempo de antelación, para que estén concientes del caso, de la decisión pendiente y de sus planes. Envíe un comunicado de prensa tan pronto como sea emitida la decisión de la Corte, con noticias acerca de la decisión, la demanda de liberar a los Cinco y los detalles de su(s) evento(s). Nosotros tendremos una rueda de prensa telefónica inmediatamente después del anuncio de la decisión con los abogados de defensa, para que puedan hacer sus comentarios respecto al fallo. Difundiremos esa información de inmediato.

5. Tan pronto como sea anunciada la opinión de la Corte lanzaremos una campaña masiva de envío de cartas al Presidente y al Fiscal General de los Estados Unidos, exigiendo la liberación de los Cinco y no más apelaciones del gobierno contra ellos.
